Thank you for visiting CADECA.org (the “Web Site”) and reviewing our privacy policy and Terms of Use. These “Terms of Use” set forth the terms and conditions that apply to your use of CADECA.org (the “Web Site”). By using the Web Site (other than to read this page for the first time), you agree to comply with all of the Terms of Use set forth herein. The right to use the Web Site is personal to you and is not transferable to any other person or entity. Your privacy is important to us, and out policy is simple: we will collect no personally identifiable information about you when you visit the Web Site unless you choose to provide that information. This Privacy Policy does not describe information collection practices on other sites, including those linked to or from the Web Site.

            The server on which the Web Site is located collects and saves only the default information customarily logged by web server software. Such information may include the date and time of your visit, the originating IP address, and the pages and images requested.

            The Web Site is not directed to children less than thirteen (13) years of age, and children under such age must not use the web site or services offered on it to submit any individually identifiable information about them.

B.     No person is authorized to use, copy or distribute any portion of the Web Site including embedded graphics unless permission is obtained from the California Association of DECA.

C.     The CA DECA seal and other trademarks or service marks (including logos and designs) found on the Web Site are trademarks/service marks that identify the California Association of DECA. Such marks may not be used by anyone that is not affiliated with CA DECA, and may not be placed on any items to be sold without the prior written authorization of the State Executive Director/Advisor. 

D.     Please be advised that DECA has registered all of its designating emblems, logos and insignia including those shown on the Web Site. DECA advisors are permitted to use only the trademarked official DECA logo on printed materials, promotional items and displays with the important exception that they may not be used on items that are for resale. These restrictions also apply to the words (in any form) DECA, (Inter)National Conference, Career Development Conference or An Association of Marketing Students.

E.     The collegiate style crest design and the graphic logos used on all merchandise and apparel may not be used for any purpose whatsoever; they are merchandising designs exclusively for DECA IMAGES products.

F.      Anyone illegally using the DECA and DEX protected logos and graphics for their own gain, takes money out of the scholarship and program funds that benefits all DECA members and may face legal action.

5.         No Representations or Warranties; Limitations on Liability

            CA DECA, INC. DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS, OR ENDORSEMENTS WHATSOEVER (INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) WITH REGARD TO THE WEB SITE, THE MATERIALS, ANY PRODUCTS, INFORMATION OR SERVICE PROVIDED THROUGH THE WEB SITE, OR ANY SITES LISTED THEREIN, AND THE WEB SITE WILL NOT BE LIABLE FOR ANY COST OR DAMAGE ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY SUCH TRANSACTION. THE WEB SITE DOES NOT WARRANT THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS IN IT WILL BE CORRECTED. THE WEBSITE IS PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS.

            You agree to indemnify, defend, and hold harmless the Web Site and its members, managers, officers, employees, agents and the assigns of same, from and against any and all loss, costs, expenses (including reasonable attorneys’ fess and expenses), claims, damages, and liabilities related to or associated with your use of the Web Site and any violation of the Terms of Use or Privacy Policy by you.

            This Privacy Policy and the Terms of Use of the Web Site constitutes a contract made under and shall be governed by and construed in accordance with the laws of the State of California.
